Process: What to Expect

Every case is unique, but the process is clear. Here is description of the steps that we will follow together.

Family Mediation

  1. You and/or your former partner contact me here. I will contact you within 2 business days.
  2. Each party completes an intake form.
  3. I will have a call with each party to verify the suitability of your case for family mediation.
  4. We will set up an in-person or virtual appointment for the first family mediation session. During this session we will review and sign the mediation contract.
  5. There will be documents for you to gather and share in between the mediation sessions.
  6. We will have several meetings as we work to come to a mutually satisfactory agreement on all aspects of your separation.
  7. I will present you with the Summary of Agreements for your review and approval, if you come to an agreement on some or all topics.

Possible next steps (see the following section, starting from step 4): I can prepare a joint application for you for a fixed rate if:

 

    1. You are married and would like to obtain a judgment of divorce.
    2. You are not married but would like to obtain a judgment.
    3. You would like to modify the judgment currently in effect.

Joint Applications

  1. You and/or your former partner contact me here. I will contact you within 2 business days.
  2. You complete an intake form.
  3. We will set up an in-person or virtual appointment.
  4. You will be asked to prepare and share various documents with me and the other party.
  5. I will draft your joint application and accompanying documents and submit them to you for your review.
  6. Once you have approved your documents, you will have an appointment either in person or virtually to sign your documents before a Commissioner of Oath.
  7. I will submit your joint application and accompanying documents to the Superior Court
  8. I will contact you with either a follow-up from the Court or your final judgment.

Collaborative Law

  1. You contact me here. I will contact you within 2 business days.
  2. You complete an intake form.
  3. We will set up an in-person or virtual appointment.
  4. If your former partner is not yet represented by a collaborative lawyer, we send a letter to invite your former partner to participate in the Collaborative process and provide referrals to Collaborative lawyers.
  5. If your former partner accepts to participate in the collaborative process and retains a lawyer, the lawyers discuss the primary interests and priorities of their respective clients.
  6. A first 4-person collaboration meeting is held with both former partners and their respective lawyers and the participation agreement is signed.
  7. I meet with you to prepare prior to each collaborative meeting.
  8. We hold one or several collaborative negotiation meetings and confirm in writing each item on which the parties agree.
  9. The final agreement is drafted and all parties sign.
  10. Where applicable, for example in the case of a joint application for divorce, the lawyers prepare a joint application and it is submitted to the Court to obtain a final judgment.
